1. Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of the services provided by ECOMMF LLC, a Wyoming limited liability company ("Company," "we," "us," or "our"), operating under the trade name ZeroMiss, accessible at zeromiss.org.

By subscribing to or using our services, you agree to be bound by these Terms. If you do not agree, do not use our services.

2. Description of Services

ZeroMiss provides missed-call recovery and lead management services for roofing companies, including but not limited to:

• Automated call answering and lead qualification
• SMS and WhatsApp notifications
• Appointment scheduling and calendar integration
• Lead management dashboard

3. Subscription and Billing

Services are offered on a monthly subscription basis. By subscribing, you authorize us to charge the payment method on file on a recurring monthly basis until you cancel.

• Starter Plan: $297/month
• Pro Plan: $497/month
• Enterprise Plan: $997/month

Prices are in US dollars and are subject to change with 30 days' written notice. All payments are processed securely through Stripe.

4. Cancellation and Refunds

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No partial refunds are issued for unused portions of a billing period.

5. Your Responsibilities

You agree to:

• Provide accurate business and contact information
• Maintain an active Twilio account or equivalent telecommunications service as required
• Comply with all applicable laws, including the Telephone Consumer Protection Act (TCPA) and CAN-SPAM Act
• Not use our services for any unlawful, fraudulent, or abusive purpose

6. Intellectual Property

All content, software, and technology provided through ZeroMiss are the property of ECOMMF LLC and are protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the services during your active subscription.

7. Limitation of Liability

To the maximum extent permitted by law, ECOMMF LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising out of or related to your use of our services.

Our total liability shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

8. Disclaimer of Warranties

Services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not guarantee that our services will result in any specific number of leads, appointments, or revenue increases.

9. Indemnification

You agree to indemnify and hold harmless ECOMMF LLC, its members, employees, and agents from any claims, damages, or expenses arising from your use of the services or violation of these Terms.

10. Governing Law

These Terms are governed by the laws of the State of Wyoming, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Sheridan County, Wyoming.

11. Changes to Terms

We may update these Terms at any time. Material changes will be communicated via email or through the service dashboard. Continued use after changes constitutes acceptance of the updated Terms.
